The newly sworn-in President Donald Trump has signed an executive order aimed at restricting automatic birthright citizenship in the United States. The executive order reinterprets the Fourteenth Amendment to exclude certain categories of individuals born on U.S. soil from automatically receiving U.S. citizenship.
Speaking on the issue, President Trump stated: “The privilege of United States citizenship does not automatically extend to persons born in the United States.”
Key Provisions of the Executive Order
- Children Born to Undocumented Mothers:
- Individuals born in the U.S. will no longer be granted automatic citizenship if their mother was unlawfully present in the country at the time of their birth and their father is neither a U.S. citizen nor a lawful permanent resident.
- Children Born to Mothers on Temporary Visas:
- If the mother was in the U.S. legally but temporarily (e.g., under the Visa Waiver Program or on student, work, or tourist visas) at the time of birth, the child will not automatically receive citizenship unless the father is a U.S. citizen or lawful permanent resident.
The executive order asserts that the Fourteenth Amendment, which states, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States,” does not extend citizenship universally to everyone born within U.S. borders.
The order explains that the phrase “subject to the jurisdiction thereof” excludes certain categories of individuals, such as those whose parents do not have legal or permanent ties to the country. Trump’s directive also references the legislative history of 8 U.S.C. 1401, which mirrors the language of the Fourteenth Amendment.
The order emphasizes that the original intent of the Fourteenth Amendment was to address the injustices of slavery and the Dred Scott v. Sandford decision, not to guarantee citizenship to everyone born on U.S. soil.
