Court Restrains Lagos State Government From Vaccinating School Children

A Federal High Court in Lagos has prohibited the state government from vaccinating school children without written consent from their parents or guardians. This ruling was made by Justice A. Lewis-Allagoa in response to an application from the Incorporated Trustees of Equity International and Initiative, targeting the Lagos State Government and its education officials.

The court ruled on an application by the Incorporated Trustees of Equity International and Initiative, filed on October 11, 2024. It ordered the Conference of Private Schools Association in Lagos, the Lagos State Primary Healthcare Board, the Attorney General, and the Commissioner of Police to refrain from vaccinating any child in Lagos schools without parental consent, pending a further hearing on the case.

The court ordered the Respondents, along with their agents and employees, to refrain from implementing the proposed mass vaccination in Lagos State schools and other locations, as outlined in two specific circulars dated September 23, 2024. This ban applies unless they obtain prior written consent from the parent or guardian of the child, or from the adult to be vaccinated.

Barrister Mobisola Odimegwu stated that the court issued an order halting the planned mass vaccination, which was set to begin that day, until a hearing on the matter scheduled for December 9, 2024. She emphasized the importance of informed consent and urged Nigerians to consider preventive health measures while being aware of the potential risks associated with vaccines. Odimegwu called for improved public health documentation and urged citizens to investigate vaccination contents thoroughly.
