Mother Takes Dallas Daycare to Court After Alleged Mistreatment of Young Children

A mother’s concerns about her three-year-old daughter’s behaviour led to a closer look at her daycare, an incident that resulted ina caregiver’s arrest, and a lawsuit questioning the facility’s oversight practices.
For Fran Wilson, confidence in her daughter’s daycare began to unravel when she noticed changes in the little girl’s behaviour. What followed was an unannounced visit to the childcare centre, an alleged incident involving two young children and a legal dispute over the facility’s responsibility for their care.
Wilson had enrolled her three-year-old daughter at The Learning Experience on Frankford Road in Dallas after researching the centre and speaking with its director. She said those initial conversations had reassured her that her child would be in a trustworthy environment.
Over time, however, Wilson noticed that her daughter no longer seemed like herself. The child, whom she described as bubbly, sociable and independent, reportedly began having nightmares, became unusually clingy and resisted being separated from her mother.
According to Wilson, her daughter also disclosed that a teacher had hit her.
Concerned by these developments, Wilson decided to visit the centre without prior notice on September 3. During that visit, she said she watched live classroom footage alongside the director and another employee.
What she says she witnessed prompted further questions about the treatment of children inside the facility.
Wilson alleged that a caregiver forcefully pulled her daughter’s arm, causing the child to stumble towards a sink. She also reported seeing the caregiver seize a young boy by his shirt and throw him down.
The allegations led to an investigation and the caregiver’s arrest.
Arrest follows allegations involving two children
Information provided to CBS News Texas indicated that the caregiver was arrested on two assault charges arising from the incident.
The Learning Experience subsequently confirmed that the individual was no longer employed at that location. CBS News Texas reported that it had attempted to contact the caregiver for comment but had received no response.
For Wilson, the incident raised concerns beyond the conduct she said she witnessed. She questioned whether other troubling interactions might have occurred before her visit and whether the daycare’s existing oversight arrangements had been sufficient.
She later filed a lawsuit against the facility, seeking accountability and answers about what happened.
The legal action places the daycare’s practices under scrutiny, although the allegations against the caregiver and the claims made against the business must be distinguished from any conclusions that may ultimately be reached through legal proceedings.
Classroom cameras become a point of contention
One of the central questions concerns the purpose and effectiveness of the daycare’s surveillance system.
The Learning Experience states on its website that cameras are installed in classrooms and monitored from administrative offices. Yet Wilson’s attorney, Russell Button, said the daycare had indicated that the incident was not recorded.
That apparent discrepancy prompted Button to question whether the camera system was serving its intended purpose. He also alleged that caregivers knew cameras were installed in the classrooms.
The available information does not independently establish whether a recording of the incident existed, whether staff were monitoring the footage at the time or what employees understood about the surveillance arrangements.
The company declined to discuss the specifics of the case, citing ongoing legal proceedings. In its statement to CBS News Texas, it said the safety and well-being of children in its care were its highest priority.
State inspection adds another dimension to the case
Separate from the family’s legal action, Texas Health and Human Services investigated the childcare facility.
The agency’s public monitoring record identifies findings concerning “Grabbing and Pulling” and a failure by employees and caregivers to demonstrate competency, good judgment and self-control.
The findings are available in the agency’s official childcare monitoring and inspection record.
These regulatory findings provide additional context about the facility’s oversight. Their precise scope should nevertheless be considered separately from the allegations in the lawsuit and the circumstances surrounding the caregiver’s arrest.
