State Supreme Court Rules Religious Charter School is Unconstitutional

The Oklahoma Supreme Court has declared unconstitutional the nation’s first publicly funded religious charter school. This decision follows the board’s controversial 3-2 vote in June 2023 to approve the application for St. Isidore of Seville Catholic Virtual Charter School. Oklahoma Attorney General Gentner Drummond had previously warned that such funding violated state law and could lead to legal repercussions and costs. Despite Governor Kevin Stitt’s support for the school, citing it as a victory for religious liberty and educational choice, the court’s ruling marks a setback for the school’s establishment using taxpayer funds.
