This legislative effort came after years of discussions among lawmakers and education officials regarding school discipline, particularly concerning children affected by trauma and adverse home environments. West Virginia, grappling with high poverty rates and opioid overdoses, faces significant challenges in child welfare, with many children being raised by relatives due to parental incapacity. Notably, a study by the state Department of Education revealed concerning disciplinary trends, including high suspension rates among students in foster care, as well as disproportionate disciplinary actions against students with disabilities and Black students compared to their white peers.
